Une victoire qui ouvre la voie \u00e0 la vente et \u00e0 l\u2019exportation de pr\u00e8s de 70 objets personnels ayant appartenu \u00e0 l\u2019ic\u00f4ne de la lutte anti-apartheid. La d\u00e9cision a \u00e9t\u00e9 rendue vendredi par la Cour supr\u00eame d\u2019appel d\u2019Afrique du Sud, qui a rejet\u00e9 la tentative de l\u2019agence publique de bloquer cette op\u00e9ration<\/strong><\/em>.<\/p>\n<p style=\"text-align: justify;\">Dans son arr\u00eat, la haute juridiction sud-africaine estime que la SAHRA a fait une interpr\u00e9tation excessivement large de la National Heritage Resources Act, la loi encadrant la protection du patrimoine national. La cour a jug\u00e9 que l\u2019agence n\u2019avait pas d\u00e9montr\u00e9 de mani\u00e8re convaincante que ces biens relevaient du patrimoine national inali\u00e9nable.<\/p>\n<p style=\"text-align: justify;\">Les juges ont notamment relev\u00e9 que Makaziwe Mandela, ainsi que Christo Brand, ancien gardien de prison de Nelson Mandela \u00e0 Robben Island, avaient clairement expos\u00e9 les raisons pour lesquelles ces objets ne pouvaient \u00eatre qualifi\u00e9s de biens patrimoniaux. \u00c0 l\u2019inverse, la SAHRA n\u2019a pas r\u00e9ussi \u00e0 \u00e9tayer juridiquement sa position.<\/p>\n<p style=\"text-align: justify;\">La collection concern\u00e9e comprend plusieurs pi\u00e8ces embl\u00e9matiques de la vie de Nelson Mandela, parmi lesquelles la cl\u00e9 de sa cellule \u00e0 Robben Island, ses lunettes Aviator, une chemise fleurie, un exemplaire sign\u00e9 de la Constitution sud-africaine de 1996, un dessin au fusain sa carte d\u2019identit\u00e9, une raquette de tennis utilis\u00e9e en prison, ainsi que divers cadeaux diplomatiques offerts par des dirigeants du monde entier. Ces objets devaient initialement \u00eatre mis aux ench\u00e8res aux \u00c9tats-Unis, suscitant un vif d\u00e9bat en Afrique du Sud.<\/p>\n<p style=\"text-align: justify;\">Au-del\u00e0 de l\u2019aspect judiciaire, Makaziwe Mandela a pr\u00e9cis\u00e9 que les fonds issus de la vente serviront \u00e0 financer la construction d\u2019un jardin m\u00e9morial sur la tombe de son p\u00e8re \u00e0 Qunu.
