La nouvelle loi supprime une lourde proc\u00e9dure parlementaire jusque-l\u00e0 obligatoire<\/strong><\/em>.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Jusqu\u2019\u00e0 pr\u00e9sent, chaque restitution n\u00e9cessitait le vote d\u2019une loi sp\u00e9cifique par le Parlement. D\u00e9sormais, l\u2019ex\u00e9cutif pourra autoriser la sortie d\u2019une \u0153uvre des collections publiques par simple d\u00e9cret. Objectif affich\u00e9, r\u00e9duire les d\u00e9lais et fluidifier les d\u00e9marches dans un dossier diplomatique sensible et symbolique. Cette \u00e9volution l\u00e8ve un obstacle administratif souvent critiqu\u00e9 par les pays demandeurs. La r\u00e9forme s\u2019inscrit dans la continuit\u00e9 du discours prononc\u00e9 par Emmanuel Macron \u00e0 Ouagadougou en 2017, o\u00f9 il avait annonc\u00e9 sa volont\u00e9 de refonder les relations entre la France et ses anciennes colonies. Cette nouvelle loi concr\u00e9tise cet engagement politique, pr\u00e8s de huit ans plus tard.<\/p>\n<p style=\"text-align: justify;\">Le texte s\u2019applique aux biens culturels acquis entre 1815 et 1972, avant la convention de UNESCO sur la protection du patrimoine culturel. Toutefois, lorsque les \u0153uvres appartiennent \u00e0 des collectivit\u00e9s ou institutions publiques distinctes de l\u2019\u00c9tat, leur accord reste requis avant toute restitution. Ces derni\u00e8res ann\u00e9es, la France a multipli\u00e9 les gestes en faveur de la restitution : En 2020, 26 tr\u00e9sors royaux d\u2019Abomey ont \u00e9t\u00e9 restitu\u00e9s au B\u00e9nin. Le sabre d\u2019El Hadj Omar a \u00e9t\u00e9 rendu au S\u00e9n\u00e9gal.
