Elle estime que son adoption par l&rsquo;Assembl\u00e9e nationale \u00e9tait entach\u00e9e d&rsquo;irr\u00e9gularit\u00e9s proc\u00e9durales. Cette d\u00e9cision, rendue \u00e0 la suite d&rsquo;une saisine de la Pr\u00e9sidence de la R\u00e9publique, invalide le texte adopt\u00e9 par les d\u00e9put\u00e9s et conforte la position d\u00e9fendue par l&rsquo;ex\u00e9cutif.<\/strong><\/p>\n<p style=\"text-align: justify;\">Selon les \u00e9l\u00e9ments communiqu\u00e9s dans le cadre de la proc\u00e9dure, les juges constitutionnels ont retenu les arguments d\u00e9velopp\u00e9s par la Pr\u00e9sidence, qui d\u00e9non\u00e7ait une violation des r\u00e8gles encadrant la r\u00e9vision de la Constitution. En cons\u00e9quence, la loi ne peut produire aucun effet juridique dans son \u00e9tat actuel. Cette d\u00e9cision intervient quelques jours apr\u00e8s le recours introduit par le chef de l&rsquo;\u00c9tat. Le lundi 6 juillet 2026, l&rsquo;avocat de la Pr\u00e9sidence, Ma\u00eetre Cheikh Ahmadou Ndiaye, avait d\u00e9pos\u00e9 devant le greffe du Conseil constitutionnel une requ\u00eate en inconstitutionnalit\u00e9 contestant la r\u00e9gularit\u00e9 des travaux parlementaires ayant conduit \u00e0 l&rsquo;adoption de la loi n\u00b018\/2026.<\/p>\n<p style=\"text-align: justify;\">Dans son recours, l&rsquo;ex\u00e9cutif soutenait que la proc\u00e9dure de r\u00e9vision constitutionnelle engag\u00e9e par l&rsquo;Assembl\u00e9e nationale le 29 juin 2026 ne respectait pas les exigences pr\u00e9vues par la Constitution. Compte tenu des enjeux institutionnels, le Pr\u00e9sident de la R\u00e9publique avait demand\u00e9 un traitement en urgence de l&rsquo;affaire, sollicitant une d\u00e9cision dans un d\u00e9lai de huit jours.<\/p>\n<p style=\"text-align: justify;\">Enregistr\u00e9e sous le num\u00e9ro 6\/C\/26 par le greffe du Conseil constitutionnel, la requ\u00eate \u00e9tait accompagn\u00e9e d&rsquo;un ensemble de pi\u00e8ces destin\u00e9es \u00e0 \u00e9tayer les griefs formul\u00e9s par la Pr\u00e9sidence. Le dossier comprenait notamment des courriers officiels, des rapports d&rsquo;amendements, des proc\u00e8s-verbaux d&rsquo;huissier ainsi que des supports num\u00e9riques contenant les enregistrements audio et vid\u00e9o de la s\u00e9ance pl\u00e9ni\u00e8re du 29 juin 2026.
